AMOGAM TERMS OF USE

1. Introduction

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Amogam, Inc. ("Amogam," "we," "us," or "our"), outlining the conditions governing your use of the Amogam platform, including all associated websites, software, applications, and features (collectively, the "Platform"). Your access to and use of the Platform signifies your full understanding and unconditional acceptance of these Terms. If you disagree with any portion of these Terms, you must discontinue the use of the Platform immediately.

2. Eligibility

  • Age Requirements: You must be at least 13 years of age to use Amogam. You represent and warrant that all information provided during registration is accurate and complete. Providing false or misleading information, including misrepresenting your age, may result in account termination and potential legal consequences.
  • Account Accuracy: You are responsible for maintaining the accuracy and completeness of your account information. Amogam reserves the right to suspend or terminate accounts with incorrect or misleading information, especially those utilized for business or social networking purposes.

3. User Types

  • Standard: Users with access to social networking features and social business functionalities.
  • Seller: Includes all Standard User privileges with the additional ability to create listings for products and services.
  • Administrator: Authorized representatives of Amogam responsible for moderating content, ensuring adherence to community standards, and taking actions to maintain a healthy Platform environment. Administrators possess discretionary authority to terminate or suspend accounts, remove content, or impose restrictions without prior notice or obligation to provide justification.

4. User Conduct

  • Responsibility: You are solely responsible for your actions and content uploaded to the Platform. Use of the Platform must be for lawful purposes only and in full compliance with these Terms.
  • Prohibited Content: The following content is strictly prohibited on Amogam:
  • Content that violates any applicable law or regulation.
  • Content that is defamatory, abusive, harassing, threatening, discriminatory, or promotes hatred or violence.
  • Content that is sexually explicit, or that exploits, abuses, or endangers children.
  • Content that infringes upon the intellectual property rights of others.
  • Personal attacks, insults, unsolicited commercial communications ("spam"), or attempts to impersonate other users.

5. Intellectual Property

  • Platform Ownership: Amogam retains all ownership rights in the Platform, including its design, content, trademarks, code, and underlying technology.
  • Content License: You grant Amogam a non-exclusive, worldwide, transferable, sublicensable, royalty-free license to use, copy, distribute, modify, and publicly display your uploaded content in connection with providing and enhancing the Platform's services. You retain ownership of your content and affirm that you possess all necessary rights and permissions to grant this license.

6. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FORA PARTICULAR PURPOSE, OR NON-INFRINGEMENT. AMOGAM DOES NOT GUARANTEE UNINTERRUPTED SERVICE, ERROR-FREE OPERATION, OR THE ABSENCE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

7. Limitation of Liability

IN NO EVENT SHALL AMOGAM, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Indemnification

You agree to defend, indemnify, and hold harmless Amogam, its affiliates, and their respective officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Platform or any violation of these Terms.

9. Social Stores

  • The Platform provides social store functionality for user convenience.
  • You are solely responsible for all activities and transactions associated with your social store.
  • Engaging in fraudulent activity, money laundering, or other illegal practices through your social store is strictly prohibited and may result in account termination and legal action.

10. Beta Version Notice

This version of the Amogam Platform is in Beta. Real-world financial transactions are strongly discouraged until the official production release.

11. Termination

Amogam reserves the right to suspend or terminate your account at any time, with or without notice, for any reason, including suspected violations of these Terms.

12. Changes to Terms

Amogam may modify these Terms periodically. Your continued use of the Platform signifies your acceptance of any changes.
